Terms of Service

Welcome to TipMeHat. By creating an account or using our website and services (the "Service"), you agree to these Terms of Service (the "Terms"). Please read them carefully. If you do not agree, do not use the Service.

1. The Service

TipMeHat provides a platform that lets live performers ("Artists") receive cashless tips from their audiences ("Tippers") by scanning a QR code. Optional features include printable artwork generation.

2. Accounts

To create an Artist account you must be at least 18 years old and provide accurate information. You are responsible for safeguarding your password and for any activity under your account. You agree to notify us immediately of any unauthorized use.

3. Payments & Fees

• All payments are processed by Stripe. By using the Service you also agree to Stripe's terms.
• Stripe charges a processing fee per transaction (typically 2.9% + $0.30).
• TipMeHat charges a 5% platform fee on tips received by Artists on the Free plan. Pro plan Artists pay 0% TipMeHat fee.

4. Payouts

Tips collected (minus applicable fees) are paid out to the Artist's bank account through Stripe Connect, subject to Stripe's standard payout schedule and verification requirements.

5. Acceptable Use

You agree not to use the Service to:

• upload content that is illegal, hateful, defamatory, sexually explicit, or infringes third-party rights;
• impersonate another person or misrepresent your affiliation with any artist or organization;
• attempt to interfere with, probe, or disrupt the Service or its security;
• use the Service for money laundering, fraud, or any unlawful purpose.

We may suspend or terminate accounts that violate these rules.

6. Content & Intellectual Property

You retain ownership of the content you upload (photos, names, artwork, etc.). You grant TipMeHat a non-exclusive, worldwide license to host, display, and reproduce that content solely to operate and promote the Service. The TipMeHat name, logo, and platform are our property.

7. Disclaimers & Limitation of Liability

The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, TipMeHat is not liable for indirect, incidental, or consequential damages, or for any loss of tips, data, or revenue arising from your use of the Service.

8. Termination

You may close your account at any time from your dashboard. We may suspend or terminate access to the Service if you breach these Terms or if continued operation poses legal or security risks.

9. Changes

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Service. Continued use after the updated Terms take effect means you accept them.
